TERMS & CONDITIONS
1. Introduction
1.1. By accessing any membership, goods or services provided by Breathe Life of Wellness Pty Ltd (“Breathe Life of Wellness”), you acknowledge and agree to abide by these terms and conditions.
1.2. Please read and understand these terms and conditions carefully before proceeding.
1.3. Breathe Life of Wellness reserves the right to amend these terms and conditions by providing written notice to you. Your continued use of Breathe Life of Wellness goods and/or services or maintenance of your membership after receipt of any amendments to these terms and conditions will constitute acceptance by you of all amendments to the terms and conditions.
2. Pricing
2.1. Pilates
2.1.1 Classes – Mat/ Mat Mix:
Casual – (50 Min) – $24
10 Class Session Pack $220 to be used within 12 weeks from the date of purchase
Classes – Reformer:
Casual – (45 Min) – $35
10 Class Session Pack $300 to be used within 12 weeks from the date of purchase
Classes (Pilates Mixed Package):
10 Class Pack (5 Mat Mix & 5 Reformer Classes) – $260
2.2. Pilates Memberships
All memberships are a 12 week commitment, paid fortnightly, with 3 weeks of pause.
2.3. Pilates Private Sessions
30 minute:
a) 1 on 1 Session Pack $44,
b) Duos $30 each;
c) 10 Session Pack $400 to be used within 12 weeks from the date of purchase
50-minute:
a) 1 on-1 Session Pack $70,
b) Duos $50 each
c) 10 Session Pack $650 to be used within 12 weeks from the date of purchase
2.4. Bowen
3. Memberships
3.1. Breathe Life of Wellness offers memberships and packs.
3.2. The member will pay membership fees weekly in advance via the Direct Debit Agreement with a third party provider, utilizing the credit or debit card provided to Breathe Life of Wellness that is safely kept on file.
3.3. Your credit or debit card will be debited for the fees due under these Terms and Conditions.
3.4. If you fail to comply with the Direct Debit Agreement, Breathe Life of Wellness will attempt to contact you for payment resolution.
3.5. Failure to pay will result in you being unable to participate in classes, and cancellation of your membership.
3.6. Membership is non-refundable and non-transferable.
3.7. Weekly classes included in the membership are valid for that week only. Unused classes at the end of the 3 month membership period will expire and cannot be redeemed for credit. Each membership is entitled to a total of three week pause period, which can be taken in blocks of one week each or together as one block. Request for a membership pause must be given in writing no less than 7 days before the start date of that pause. A pause period is then added on to the end of the membership/Session Pack. You will not be charged for this pause period, but a pause period cannot exceed three (3) weeks in total for each membership.
3.8. It is your responsibility to ensure sufficient funds are available for ongoing membership payments to avoid additional fees from third-party service providers.
3.9. For all packs purchased this fee must be paid at the time of purchase and before use. All packs must be used in the timeframe allocated for use.
4. Booking and Payment
4.1 Classes and appointments can be booked through the App / Client portal / Breathe Life of Wellness website and are non-transferable and non-refundable. If someone other than the person registered to attend the class or appointment arrives to attend and participate in the booked class or appointment, they will be refused entry. If for any reason you are unable to self-book through the website, please contact the Breathe Life of Wellness staff to make the bookings for you via email, sms or in-person.
4.2 Bookings are subject to availability as maximum class numbers apply. The times and maximum class numbers are determined by Breathe Life of Wellness. Breathe Life of Wellness may change hours for public holidays.
4.3 Payment is required in advance for all single classes, private classes, packs and prior to the commencement of that week of the membership under the Direct Debit Agreement.
4.4 Please note that single and private class and appointment availability is on a first-come, first-served basis. To avoid disappointment, classes and appointments can be booked in advance up to 3 months ahead.
4.5 If you are unable to attend a booked class or appointment, please ensure that you cancel 24 hours prior to the class or appointment time and date with Breathe Life of Wellness.
4.6. EARLY CANCELLATIONS PRIOR TO 24 HOURS: In the case of early cancellations prior to 24 hours notice for an appointment / class, you won’t be refunded for that appointment / class but have a period of 3 months to make it up.
4.7. LATE CANCELLATIONS OF LESS THAN 24 HOURS BUT MORE THAN 3 HOURS:
In the event of late cancellation with notice of less than 24 hours before the scheduled class / private consultation but more than 3 hours prior is provided to Breathe Life of Wellness, the monies paid for that class will not be refunded but the class is returned to your account with an expiry date: (Please note in the case of pilates classes, this credit cannot be used to come off your next pack or membership payment, only as a single class credit)
4.8. NO SHOWS OR CANCELLATIONS OF LESS THAN 3 HOURS
If you are absent from a class / appointment without prior cancellation, or with less than 3 hours notice of a cancellation, you will be charged for that class as if you attended and that class / private consultation will be forfeited.
4.9 RECURRING PILATES BOOKINGS
If you fail to cancel your classes and don’t attend classes for 2 consecutive weeks, you will automatically be removed from being a recurring booking for that class.
4.9 CANCELLATION OF CLASS OR APPOINTMENT BY BREATHE LIFE OF WELLNESS
In the event of a late class or appointment cancellation by Breathe Life of Wellness due to unforeseen circumstances, you will be permitted to book another session to replace the cancelled class or appointment either within a period of not more than thirty (30) day from the cancellation.
4.10 Notwithstanding the above, you may contact the Breathe Life of Wellness team to discuss credit options due to unforeseen and special circumstances. Any credit in these circumstances will be at the sole discretion of the Breathe Life of Wellness and will be subject to you attending the class on another scheduled date. If the class is not attended on the re-scheduled date, no further credit will be provided
5. Waitlist
5.1. If the class you desire is already at maximum capacity, you can register on the waitlist for the class by emailing Breathe Life of Wellness.
5.2. In the event that a spot in a full class becomes vacant and you are on the waitlist, we will inform you by email or text message, that a position has become available in the class.
6. General Terms and Conditions of Entry
6.1. You acknowledge and consent that Breathe Life of Wellness conducts, or may at any time conduct, continuous Closed-Circuit Television (CCTV) monitoring for security purposes.
6.2. Breathe Life of Wellness may take photographs, audio or video for promotional and marketing purposes. You agree to your image, video or audio being take and used by Breathe Life of Wellness for such purposes unless you advise us by email that you do not wish your photo to be taken by Breathe Life of Wellness.
6.3. Before the start of each class or appointment, you must inform and disclose to Breathe Life of Wellness any injuries, illnesses or any medical conditions that may affect your ability to participate in the class activities, the appointment or use Breathe Life of Wellness’ equipment or facilities or that have changed since the last time you were at Breathe Life of Wellness.
6.4. Any injuries or accidents that occur during a class or appointment must be immediately reported to Breathe Life of Wellness.
6.5. Breathe Life of Wellness reserves the right to:
6.5.1. Restrict members to specific class types or appointments or limit certain activities or the use of particular equipment or facilities based on health and safety considerations of the member or attendee; and
6.5.2. Deny your participation in a class or appointment if Breathe Life of Wellness believes that you are not medically fit or capable of performing the class activities or using Breathe Life of Wellness’ equipment or facilities.
6.6. In the event of any inappropriate or unlawful behaviour witnessed or experienced by you, it must be promptly reported by you to Breathe Life of Wellness staff.
6.7. It is your responsibility to take care of your personal belongings (e.g. keys, wallets) while you are at Breathe Life of Wellness. Valuables should not be bought into the premises. If you choose to bring personal belongings to Breathe Life of Wellness, please ensure they are kept with you at all times. Breathe Life of Wellness takes no responsibility should your personal belongings be lost and/or stolen.
6.8. Any lost property should be immediately handed over to the reception or staff of Breathe Life of Wellness. Lost property items will be held for a period of six (6) months before being donated to charity.
6.9. Access to Breathe Life of Wellness is only granted to members during class hours and appointment times, provided they have made a booking before arrival to a class or appointment.
9.10. Breathe Life of Wellness reserves the right to remove you from a class, appointment or the studio if, in our opinion, you violate any of the aforementioned requirements or fail to comply with these terms and conditions
7. Code of Conduct
By using our services, you agree to adhere to the following code of conduct:
7.1. Use all equipment with care and follow the instructions provided by Breathe Life of Wellness’ Staff;
7.2. Respect and comply with the directions provided by Breathe Life of Wellness’ Staff at all times;
7.3. Respect and follow all signs and instructions displayed throughout Breathe Life of Wellness;
7.4. Act in a safe, hygienic, appropriate, and lawful manner at all times;
7.5. Refrain from causing any loss or damage to the property of Breathe Life of Wellness or any other person;
7.6. Avoid disrupting or harming other members or classes or appointments in any way;
7.7. Be respectful and courteous to all individuals within Breathe Life of Wellness;
7.8. Refrain from consuming alcohol or smoking cigarettes/vapes at Breathe Life of Wellness.
8. Age Policy
8.1. Minors between the ages of 14 and 18 years may be eligible to become a member or attend a class or appointment with the written consent and signature of their parent or legal guardian, save for Pilates Conditioning Classes where ages 10 to 14 may be accepted by Breathe Life of Wellness. Special classes and appointments may be run and approved for ages younger than 14 years with the express written consent and signature of their parent or legal guardian but this is at the sole discretion of Breathe Life of Wellness. Please note that for Bowen Therapy any age under 18 years old can make an appointment with the express written consent and signature of their parent or legal guardian.
8.2. Minors must comply with all safety requirements of Breathe Life of Wellness as directed by its staff.
8.3. Breathe Life of Wellness reserves the right to cancel the Membership of a minor for inappropriate behaviour, equipment misuse, or failure to comply with directions from Breathe Life of Wellness staff.
9. Termination of Membership
9.1 Breathe Life of Wellness reserves the right to terminate your membership or pack under the following circumstances:
(a) Failure by you to comply with any of the Terms and Conditions;
(b) Non-resolution of arrears in your Direct Debit Account after receiving reasonable notice from us requiring you to do so or failure to pay for your pack unfront;
(c) Engaging in unsafe behaviour or conduct that puts in danger the health, safety, or well-being of other members of Breathe Life of Wellness;
(d) Temporary or permanent closure of Breathe Life of Wellness.
10. Suspension
10.1 Breathe Life of Wellness may suspend your Membership immediately if you fail to comply with the Terms and Conditions. We will provide written notification regarding the suspension and what is required to be undertaken by you before recommencement of your membership.
10.2 Clients on a membership can suspend their membership by providing written notice to Breathe Life of Wellness at least 7 working days prior to the intended recommencement date. Any suspension can be for a maximum period of three weeks from the date of the suspension and not more than three weeks can be added to the end of a membership period or pack.
12. General Provisions
12.1 These Terms and Conditions represent the complete agreement between the member and Breathe Life of Wellness concerning the subject matter and replace any prior written or oral agreements.
12.2 If any provision of these Terms and Conditions is prohibited, invalid or unenforceable, it will be ineffective to the extent of the prohibition, invalidity, or unenforceability without invalidating the remaining provisions.
12.3 Any notices or communications between parties under these Terms and Conditions must be in writing and by email to the recipient’s specified address or any new address communicated by the recipient.
12.4 Breathe Life of Wellness obligations under these Terms and Conditions will be suspended during events of force majeure, which are circumstances beyond its reasonable control, such as pandemics, natural disasters, government actions, or other unforeseeable events.
12.5 Members are not permitted to assign any rights under these Terms and Conditions without prior written consent from Breathe Life of Wellness.
12.6 Nothing in this agreement is intended to create an employment, agency, partnership, fiduciary, or joint venture relationship between Breathe Life of Wellness and any member.
12.7 These Terms and Conditions shall be exclusively construed, interpreted, and controlled according to the laws of South Australia.
LIABILITY WAIVER
By participating in classes or an appointment and using the equipment and facilities at Breathe Life of Wellness, you warrant and represent that you are medically fit to undertake physically demanding exercises conducted during classes or appointment and you agree not to participate in exercises that cause any pain or discomfort, particularly to your neck, back, joints or any pre-existing injury.
